Jack Davis Videos — Terms of Service (TOS)

Welcome to Jack Davis Videos (“JDV,” “we,” “us,” “our”).
By purchasing any product, subscription, add-on, exclusivity upgrade, or service from JDV, you (“Client,” “Customer,” “You”) agree to the following Terms of Service.

If you do not agree with these terms, do not purchase or use our products or services.

1. Services Provided

Jack Davis Videos provides digital video production services, including but not limited to:

• Custom-branded video templates
• AI-generated voiceovers
• Editing and production
• Vertical video formatting
• Revisions
• Subscription-based video delivery
• Exclusivity upgrades (DMA protection)
• Video coaching and onboarding calls
• Access to private communities

All services are delivered digitally. No physical goods are provided.

2. Payment Terms

2.1 Subscription Payments

• Subscriptions are billed monthly until canceled.
• Payments must be made by credit/debit card at checkout.
• Failed payments will automatically retry; if payment fails after repeated attempts, services may pause or terminate.

2.2 One-Off Purchases

• One-time purchases are charged immediately at checkout.
• All sales are final once production begins.

2.3 Discounts

• Advantage Club members receive a 10% discount on standard video products only.
• Discounts do NOT apply to subscriptions, DMA exclusivity upgrades, or coaching calls.

3. Refund Policy

Because of the custom nature of digital production:

All sales are final and non-refundable.

This includes:

• Subscriptions
• One-off videos
• Video packages
• DMA exclusivity
• Add-ons
• Coaching calls
• Revisions
• Discounts

If a mistake is made by JDV, we will correct the issue as part of our revision policy.

4. Production Timeline

4.1 Standard Turnaround (Dominance Plan & One-Off Products)

5–7 business days.

4.2 Priority-PLUS Turnaround (Advantage Club)

3–5 business days.

4.3 Revision Timeline

24–48 hours depending on complexity.

Delays caused by missing client information are not JDV’s responsibility.

5. Revisions

• Each video includes one standard revision.
• Additional revisions require the purchase of the Extra Revision Add-On ($47).
• Revisions must be requested within 7 days of delivery.
• Revisions do not include redesigning, rewriting, or re-templating the video.

6. Client Responsibilities

Client agrees to:

• Provide accurate branding information (logo, colors, messaging).
• Provide correct business information.
• Approve scripts or assets in a timely manner.
• Respond within 72 hours if clarification is needed.
• Not request revisions that exceed the scope of the purchased package.

Failure to provide timely responses may extend deadlines.

7. File Ownership & Licensing

7.1 Client Ownership

Upon delivery and full payment:

• Client receives lifetime usage rights to the custom-branded video(s).
• Videos may be used on all digital platforms unless otherwise restricted by platform policy.

7.2 JDV Ownership

JDV retains ownership of:

• Raw template files
• Project files
• Editing structures
• Voiceover models
• Custom-built tools
• Production processes
• All intellectual property not explicitly sold

Clients may not resell, recreate, or redistribute JDV templates.

8. Exclusivity (DMA Retirement)

8.1 Single Template DMA Exclusivity

• Public price: $997
• Advantage Club price: $797
• Applies to ONE template in ONE Nielsen DMA.
• Exclusivity is permanent for that DMA.
• Exclusivity is non-transferable and non-refundable.

8.2 DMA Premium Exclusivity (12 Templates)

• Price: $2,997
• Grants permanent exclusivity for up to 12 templates in 1 DMA.
• Only Advantage Club members are eligible to purchase this package.

8.3 DMA Boundaries

Exclusivity is governed by Nielsen DMA maps and not by ZIP codes, counties, city limits, or customer-defined boundaries.

8.4 JDV Rights

JDV reserves the right to:

• Decline exclusivity requests in congested markets.
• Confirm DMA boundaries prior to approval.
• Refuse exclusivity when geographic conflicts occur.

9. Coaching Calls

• The 30-minute coaching call is a one-time onboarding bonus for Advantage Club members.
• Must be scheduled and completed during the onboarding period.
• Coaching does not constitute legal, financial, or compliance advice.
• Implementation services may be offered separately at additional cost.

10. Facebook Group Access

• Access is granted only to current Advantage Club subscribers.
• JDV may remove members who violate community rules, spam, harass others, or misuse the group.
• Content inside the group is for educational purposes only.

11. Limitations of Liability

Client understands and agrees that:

• JDV is not responsible for platform bans, ad disapprovals, or account issues on Facebook, Google, YouTube, or others.
• JDV does not guarantee lead volume, revenue, or business growth.
• JDV provides creative and production services only.

Maximum liability shall not exceed the fees paid in the previous 30 days.

12. No Copying or Reverse Engineering

Client agrees not to:

• Copy JDV’s production style.
• Rebuild JDV templates.
• Reproduce JDV assets for resale.
• Use JDV content in competing services.

Violation may result in termination and legal remedy.

13. Termination

JDV may terminate service for:

• Abusive or threatening behavior.
• Attempting to scam DMA exclusivity.
• Chargebacks or disputed payments.
• Misuse of content.
• Violation of these terms.

Subscriptions may be canceled by the client at any time.
Cancellations take effect at the next billing cycle (no partial refunds).

14. Changes to Terms

JDV may modify these Terms of Service at any time.
Updated terms will be posted on the JDV website.

15. Governing Law & Arbitration

This agreement is governed by the laws of the State of Missouri.
All disputes shall be resolved through binding arbitration in Jasper County, MO.
No class-action claims are permitted.

16. Acceptance of Terms

By purchasing any JDV product or service, Client agrees to these Terms of Service in full.
